Please read these Terms of Use ("Terms of Use", "Terms", "Terms and Conditions") carefully before using the Application Services operated by DopaAI ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

Data

DopaAI does not store your data in any form whatsoever anywhere, we do upload it to our server to run the Machine Learning model on it to return the result, but it is not saved or is reproducable.

User Generated Content

You are solely responsible for your use of our Services and any videos, messages, information and any other content you create through our Services, whether transmitted privately or made publicly available (collectively, "User Content"). You retain ownership of your User Content. Any pictures/videos you make using our Services are stored locally on your phone and are not stored or uploaded to our Services/servers. You understand and agree to comply with all applicable laws regarding your use of our Services and User Content.

You should always ensure that your user content does not:

A. contain any content, information or material that infringes any third party rights (including copyright, trademark, confidential information or privacy rights);

B. violate any applicable laws;

C. contain any content or material that is offensive, abusive, defamatory, libellous, derogatory, bullying, discriminatory, obscene, violent, pornographic, indecent, promotes or encourages violence, terrorism or any other illegal behavior, or may harass, upset, humiliate, alarm or inconvenience any person;

D. in any way promote or incite anyone to commit or assist in any illegal or criminal activity that may endanger the safety or well - being of others;

E. identify any person without their consent or, if under 18, the consent of their parent or legal guardian;

F. disclose any person's personal contact details or invade their privacy;

G. contain any viruses or other malicious or harmful programs.

In addition, you understand and agree that you will not do or attempt to do any of the following when using our services, nor will you cause any third party to do or attempt to do any of the following:

A. use our services or user content available on our services in a manner other than as expressly permitted by these terms and the normal functioning of our services;

B. use our services for any illegal purpose in an unlawful manner or in any manner inconsistent with these terms;

C. use our services in a manner that could damage, disable, overload, impair or endanger our services, our systems or security, or interfere with other users;

D. use any program or other means, including but not limited to scripts, spiders and robots, whether manual or automatic, to extract, download, index, mine, crawl, copy or circumvent the display, operation or intended use of our services or any of their features or functions;

E. copy, modify, decompile or otherwise interfere with any part of our services;

F. alter or modify all or part of our services, or allow our services or any part thereof to be merged or incorporated into any other program;

G. hack or insert malicious code (including viruses or harmful data) into our services;

H. violate our intellectual property rights.

Copyright

DopaAI respects the intellectual property of others, and we ask our users to do the same. DopaAI will promptly process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws with respect to any alleged or actual infringement.

Third Party Services

Our service includes and links to features and services (including but not limited to, social applications like Facebook, Instagram) that are provided by a third party. We do not control such third-party sites or services and are not responsible for the content or functionality of such sites or services. Our inclusion of links does not imply any endorsement or association with their operators. The terms applicable to the use of such third-party services will apply and we will not be responsible for anything that is done by you or the third party service provider in connection with your use of their service. Please note that we do not keep your private personal information like your account, ID, password and etc. on the third-party apps/websites in our services.

Advertising

We may deliver advertising to you in conjunction with your use of our services.

Indemnification

You agree to indemnify DopaAI and hold it and any of its officers, directors, employees, agents, and affiliated and related entities harmless from and against any claim, dispute, costs, losses, liability, damages, expenses, and judgments of all types. This includes, without limitation, reasonable legal and accounting fees that arise from or are in any way related to (a) your access to or use of the services, (b) your user content, or (c) your violation of these terms.

Disclaimer and Limitation of Liability.

Except as expressly set forth in this Terms, neither we, our affiliates, subsidiaries nor the Licensors make any other warranties, express or implied, including any implied warranties of merchantability and fitness for a particular purpose. We, our affiliates, subsidiaries and the Licensors expressly disclaim all warranties not stated in this Terms. Any implied warranties that may be imposed by law are limited to the terms contained in this Terms to the maximum extent permitted by law.

General Term and Conditions

This Terms constitutes the entire agreement between you and DopaAI with respect to the subject matter hereof and supersedes all previous and contemporaneous written and oral representations, proposals, negotiations and communications, including, without limitation, the terms and conditions of any purchase order.

We may assign this Terms or any of the rights or obligations hereunder, and any causes of action arising hereunder, to any third party without necessity or obligation of notice to you. The waiver or failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further right hereunder. The invalidity or unenforceability of any provision of this Terms will not affect the validity or enforceability of any other provision, the remaining provisions being deemed to continue in full force and effect.

We will not be responsible for any failure to perform its obligations under this Terms due to circumstances beyond its reasonable control, including without limitation acts of God, war, riot, terrorism, embargoes, acts of civil or military authorities, fire, flood or accidents. You agree that DopaAI will be entitled to all legal and equitable remedies otherwise available to it to protect the intellectual property, proprietary rights and Confidential Information of itself and its Licensors, including, without limitation, the right to seek and obtain injunctive relief and enforce the same against you without the necessity of having to post bond or other such guarantee.

Applicable Law and Disputes

For any dispute you have with DopaAI, you agree to first contact us and attempt to resolve the dispute with us informally, we each agree to resolve any dispute arising out of or in connection with or relating to this Agreement under Google Play’s rules.

This Terms will in all respects, be governed by and construed and enforced in accordance with the laws of California (without giving effect to any choice or conflict of laws). The United Nations Convention on Contracts for the International Sale of Goods will not apply to this Agreement. You consent to the jurisdiction of competent courts in California for the resolution of any dispute arising under or related to this Terms or the Products.
